("Agrodity," "we," "us," or "our") is committed to protecting the privacy and security of personal information collected through the Agrodity marketplace, platform, website, and mobile application (collectively, the "Platform"). This Privacy Policy describes how we collect, use, disclose, retain, and protect personal information from participants and visitors. This policy applies to all users of the Platform.
Information We Collect
We collect information that you provide directly to us during registration, verification, and transaction activity. This includes: (a) Identity information: full name, date of birth, government-issued identification numbers; (b) Business information: legal entity name, employer identification number, business type, industry, and trade references; (c) Contact information: email address, phone number, mailing address, and physical delivery locations; (d) Banking information: account numbers, routing numbers, and payment instructions necessary for escrow-based settlement; (e) Compliance information: sanctions screening data, beneficial ownership information, and regulatory status; (f) Transaction information: orders, bids, offers, confirmations, contracts, quality records, delivery records, and settlement records; and (g) Technical information: IP address, device identifiers, browser type, and usage data collected automatically when you access the Platform.
How We Use Information
We use personal information to: (a) verify participant identity, business, and compliance status; (b) operate, maintain, and improve the Platform; (c) facilitate, execute, and settle transactions between participants; (d) administer escrow accounts and process payments; (e) provide customer support and respond to inquiries; (f) monitor for fraud, market manipulation, and prohibited conduct; (g) comply with legal, regulatory, and law enforcement obligations; and (h) communicate with participants about Platform updates, policy changes, and transaction-related matters. We do not sell your personal data to third parties.
Legal Bases for Processing
We process personal information under the following legal bases: (a) performance of a contract with the participant, including verification and transaction execution; (b) compliance with legal and regulatory obligations, including anti-money laundering, sanctions screening, and recordkeeping; (c) our legitimate interests in operating a secure and compliant marketplace; and (d) consent, where explicitly provided by the participant for optional uses such as marketing communications.
Data Sharing and Disclosure
We share personal information with: (a) Transaction counterparties, as necessary to execute agreed transactions and complete delivery and settlement; (b) Service providers and processors who support Platform operations, including payment custodians, inspection providers, carriers, and hosting providers, under appropriate data processing agreements; (c) Regulators, law enforcement, and other governmental authorities, when required by law, regulation, subpoena, or court order; and (d) Affiliates and professional advisors, subject to confidentiality obligations. We do not sell personal information to data brokers or for advertising purposes.
Data Retention
We retain personal information for as long as necessary to fulfill the purposes for which it was collected, including for the duration of any ongoing transaction relationship and for the period required to comply with legal, regulatory, accounting, and recordkeeping obligations. Transaction records, contracts, and settlement documentation are retained for a minimum of seven (7) years or as required by applicable law. Verification and compliance records are retained for the duration of the participant relationship plus the applicable regulatory retention period.
Data Security
We implement reasonable technical, organizational, and physical safeguards designed to protect personal information against unauthorized access, use, alteration, disclosure, or destruction. These measures include encryption in transit and at rest, access controls, multi-factor authentication, regular security assessments, and employee training. Despite these safeguards, no system can guarantee absolute security, and we cannot ensure or warrant the security of any information you transmit to us.
Your Privacy Rights
Subject to applicable law and ongoing transaction obligations, you may have the right to: (a) access the personal information we hold about you; (b) correct inaccurate or incomplete personal information; (c) request deletion of your personal information, subject to legal and regulatory retention requirements; (d) restrict or object to certain processing of your personal information; (e) request portability of your personal information in a structured, machine-readable format; and (f) withdraw consent to optional processing. International Data Transfers
The Platform operates in the United States. If you access the Platform from outside the United States, your personal information will be transferred to and processed in the United States. By using the Platform, you consent to such transfers. We take reasonable measures to ensure that international transfers comply with applicable data protection laws.
Children's Privacy
The Platform is not directed to, and is not intended for use by, anyone under the age of eighteen (18). We do not knowingly collect personal information from individuals under 18. If we learn that we have collected personal information from a person under 18, we will delete that information in accordance with applicable law.
